财政部、国家税务总局关于进一步鼓励软件产业和集成电路产业发展税收政策的通知

各省、自治区、直辖市、计划单列市财政厅(局)、国家税务局、地方税务局，新疆生产建设兵团财务局：
　　为了进一步鼓励软件产业和集成电路产业的发展，经国务院批准，并根据现行税法有关规定，现对有关税收优惠政策补充通知如下：
　　一、自2002年1月1日起至2010年底，对增值税一般纳税人销售其自产的集成电路产品(含单晶硅片)，按17%的税率征收增值税后，对其增值税实际税负超过3%的部分实行即征即退政策，所退税款由企业用于扩大再生产和研究开发集成电路产品。
　　二、对生产线宽小于0.8微米(含)集成电路产品的生产企业，经认定后，从2002年开始，自获利年度起实行企业所得税“两免三减半”的政策，即自获利年度起，第一年、第二年免征企业所得税，第三年至第五年减半征收企业所得税。
　　按照《外商投资企业和外国企业所得税法》及其实施细则的规定，已经享受自获利年度起企业所得税“两免三减半”政策的外资企业，不再重复执行本条规定。
　　按照《外商投资企业和外国企业所得税法》及其实施细则的规定，可以享受自获利年度起两年免征企业所得税的外商投资企业，如果2002年(不含)之前实际享受企业所得税“两免”政策期满的，不再重复执行“两免”政策，从2002年起执行企业所得税“三减半”的政策；如果2002年(不含)之前实际享受企业所得税“两免”政策未满两年的，继续执行剩余的免税期限及“三减半”的政策。
　　按照财政部、国家税务总局《关于企业所得税若干优惠政策的通知》〔(94)财税字第001号〕的规定，执行自投产年度起两年免征企业所得税的内资企业，改按执行自获利年度起企业所得税“两免三减半”的政策。如果2002年(不含)之前已经获利并自获利年度起实际享受了企业所得税“两免”政策期满的，不再重复执行“两免”政策，从2002年起执行企业所得税“三减半”的政策；如果2002年(不含)之前已经获利并自获利年度起实际享受企业所得税“两免”政策未满两年的，继续执行剩余的免税期限及“三减半”的政策。
　　投资额超过80亿元人民币或集成电路线宽小于0.25微米的集成电路生产企业，继续按财政部、国家税务总局、海关总署《关于鼓励软件产业和集成电路产业发展有关税收政策问题的通知》(财税〔2000〕25号)执行。
　　三、自2002年1月1日起至2010年底，对集成电路生产企业、封装企业的投资者，以其取得的缴纳企业所得税后的利润，直接投资于本企业增加注册资本，或作为资本投资开办其他集成电路生产企业、封装企业，经营期不少于5年的，按40%的比例退还其再投资部分已缴纳的企业所得税税款。再投资不满5年撤出该项投资的，追缴已退的企业所得税税款。
　　自2002年1月1日起至2010年底，对国内外经济组织作为投资者，以其在境内取得的缴纳企业所得税后的利润，作为资本投资于西部地区开办集成电路生产企业、封装企业或软件产品生产企业，经营期不少于5年的，按80%的比例退还其再投资部分已缴纳的企业所得税税款。再投资不满5年撤出该项投资的，追缴已退的企业所得税税款。
　　西部地区的范围按照《国务院办公厅转发国务院西部开发办关于西部大开发若干政策措施实施意见的通知》(国办发〔2001〕73号)执行，即西部地区包括重庆市、四川省、贵州省、云南省、西藏自治区、陕西省、甘肃省、宁夏回族自治区、青海省、新疆维吾尔自治区、新疆生产建设兵团、内蒙古自治区和广西壮族自治区。湖南省湘西土家族自治州、湖北省恩施土家族苗族自治州、吉林省延边朝鲜族自治州，比照西部地区执行上述政策。
　　四、其他有关鼓励软件产业和集成电路产业的政策规定，仍按财政部、国家税务总局、海关总署《关于鼓励软件产业和集成电路产业发展有关税收政策问题的通知》(财税〔2000〕25号)执行。
　　此前政策与本通知相抵触的，以本通知为准。
